Clarence Thomas: Supreme Court Will Soon Have to Address Tech Censorship

Supreme Court Justice Clarence Thomas today outlined a detailed legal argument for why social media companies might need to be subject to strict rules forbidding them from denying service to users for any reason or no reason, including the possibility of designating them as common carriers — which would effectively eliminate their ability to ban or censor users for legal, First Amendment protected speech. 

Thomas outlined his opinion in a concurrence to reject a case that began under the Trump administration, challenging the President’s right to block users from his Twitter feed.

"I stand before you this morning to announce a very important and very beautiful, I think, development for our freedom and our freedom of speech ... today, in conjunction with the America First Policy Institute, I'm filing as the lead class action represents a major class-action lawsuit against the Big Tech giants including Facebook, Google, and Twitter, as well as their CEOs," Trump said.

Twitter removes Trump’s ‘photograph’ tweet mocking Biden over copyright issue
 It’s a little too late to “Look at this photograph,” but Twitter users who caught President Trump’s Nickelback-inspired tweet Wednesday will not soon forget it.
Twitter took down the tweet, which set a picture of Joe Biden, his son Hunter, and a Ukrainian businessman to the song “Photograph,” after Nickelback complained. The arresting caption read simply, “LOOK AT THIS PHOTOGRAPH!”
Trump’s tweet now displays a message that reads, “This media has been disabled in response to a report by the copyright owner.”
